Are you aware that California lawmakers recently introduced a bill that would allow the killing of newborn babies up to a month old?


The bill, AB2223, removes all civil and criminal penalties for any “pregnancy outcome.” A pregnancy outcome is defined in the bill as a miscarriage, abortion, postnatal care, and what is called “perinatal death.”


According to the bill’s own analysis, perinatal death includes the death of newborns for any reason and up to one month after birth. It's horrifying and you heard this correctly. A newborn baby can be killed for any reason, by any person and without civil or criminal penalty within the first month of a child's life.

AB 2223: WHAT YOU NEED TO KNOW

  • AB 2223 removes all civil and criminal liability for any pregnancy outcome, including miscarriage, stillbirth, abortion, or perinatal death.
  • The bill’s official analysis states that the “the bill could be interpreted to immunize a pregnant person from all criminal penalties for all pregnancy outcomes, including the death of a newborn for any reason during the “perinatal” period after birth.”
  • According to the official analysis, the “perinatal” period is either “generally used to describe the period from approximately past 22 (or 28) completed weeks of pregnancy up to 7 completed days of life,” or “the period from the establishment of pregnancy to one month following delivery.”
  • The bill establishes a blanket prohibition on civil or criminal liability for anyone aiding or assisting a woman seeking to end the life of her child with the consent of the child’s mother, regardless of the outcome – i.e., even if the baby is born alive and then killed up to one month after birth.
  • The bill removes existing requirement for a coroner inquiry into the death of a baby following a self-induced or criminal abortion. It removes the requirement that every unattended death of a baby delivered after 20 weeks’ gestation be handled as a “death without medical attendance.”
  • The bill prohibits using coroner’s statements on the baby’s death certificate death for the purpose of criminal prosecution or civil damages.
  • The bill creates a right to “self-managed abortion” at any stage of pregnancy. Self-managed abortion is defined as “ending one’s own pregnancy outside of the medical system.
